Both. Patent law does not cover writing, but the production of
devices. The people who are telling you otherwise, e.g. the mpeg4 guy
you corresponded with, are trying to create new "de facto" law by
convincing the world that their (stupid) opinion is already the law.
If people believe them and succumb to their lies, they have a chance
of success.
