The answer depends on your CPU. (I think. I don't have reports from
enough different people to tell what exactly causes the difference.)
Here (AthlonXP 2500 & Athlon64 3400) ffmpeg12 is faster, and has been so
for a long time.

Opendivx != DivXNetwork.
Way back when, there were some people called ProjectMayo who wrote
opendivx. ProjectMayo forked, and some of the members became DivXNetwork,
and wrote a new closed source codec.
