Two months since what? Isn't 190.42 the first official release that
supports this? It was released on 2009-10-29. Yes beta versions have
existed for longer, but we shouldn't require beta versions of drivers
that can break the whole desktop.

Some of the fast libx264 updates have been for versions that were not
backwards compatible, so the choice was between not supporting old at
all or not supporting new at all (or adding more complicated
workarounds).

That may be the minimum supported level of bitstream features, but I
don't believe it's meant to imply a limit on supported decoding *speed*.
Decoding a stream at a higher fps only requires doing it faster, and the
cards openly differ in how fast they can do decoding.
