If you use the binary codec (I am not aware of any other way), that is
free for personal use only. For anything else you'll definitely have to
wrangle with On2 yourself (and I fear you will have to wrangle since that
kind of use is not within the standard stuff they sell).
And I also think even non-commercial publishing of stuff wouldn't count
as "personal use".

You mean On2 Flix? That uses mencoder, too (though in combination with
other tools IIRC).
