Is 40kbps the absolute maximum (for whatever reason) or can you exceed
that for short periods?  If you can, you can certainly get much better
quality with variable bitrate.

If you really do get "ghosting" (as opposed to some other artifacts as
Rich has suggested) you probably have a telecined or interlaced
source video.  The documentation explains in detail how to handle either
one.
