We're not talking about dynamic linking here though, but runtime loading.
Can I not use VAAPI because the underlying driver behind it may be closed
source?

In fact we talked about this exact topic with j-b the other day, and he is
the closest to a lawyer we have around here ;), and he agreed that FFmpeg
built against the mfx dispatcher is no problem - it only becomes a problem
when you start distributing the Intel binary with it, which you shouldn't
do.
