Non, and I have already explained why: you still build-depend on the
headers.
To avoid depending on a "patent-encumbered" library, you just have to create
a fork of said library where you remove all "patent-encumbered" code while
keeping it API- and ABI-compatible with the original. The fork does not need
to do something useful at all, just printing an error message is enough.
As for the claim that libvpx is not "patent-encumbered", Jason has covered
it details in his blog.
