I saw a thread regarding that patch in the archives, and a stack of constructive criticisms surrounding this patch, but I was unable to locate the patch itself.
I'm sure that if I release software which uses libavformat/libavcodec it will be with my patch (barring some officially supported mms-patch).
I wanted to contribute back the delta if the community wanted it and because I believe this is required by the license.
If the community is not interested in a libmms-derived solution, what would be the best way to comply with the legal-aspects of distributing a derived version of this most excellent library?
-- Make the patch available via the web?
-- Distro the src/patch with the binary?
-- Submit the patch despite it being unwelcomed?

A patch was submitted for that a long time ago. I still have it locally and
can re-submit although I'm not its author (it still applies). Use google for
details.
